Parents Visa Rejected by UKBA India

Post by cleansewell » Thu Apr 26, 2012 9:45 pm

My parents applied for 2 year Family visit on the basis that the entire trip, costs, etc is taken care by 3 sponsor i.e. 3 sons. UKBA India refused entry clearance stating that the case worker was not satisfied whether my parents will return back to India given that my parents are wholly dependent on 3 sons. By the way, all 3 sons are fully employed and do have good financial conditions which was justified by all the bank statements, payslips, etc.

He case worker also states that since I mentioned in my application that parent would like to stay in UK for 2 years, I did include a covering letter clarifying that both sponsor and applicant is aware of the rule that parents must exit UK before end of 6 months. Still the case worker rejected without considering the cover letter.

PLease note that this is my parents second trip to the UK and they have not overstayed during their first trip. All the 3 sponsors have a clean records.

Can someone advice any outcome on appeal process based on the above details?

Based on the above details (there are no real details) it's not possible to comment. Even if you cited the entire refusal notice and gave a complete breakdown of their financial and social situation in their homeland, it would still be difficult to comment on the possible outcome. I would suggest you get legal help with the appeal if you are unsure on what points of the actual refusal you need to challenge.
