About Rights of Siblings of EU Family

Post by OTHER_EUFamMem » Fri Apr 27, 2012 3:21 am

Hello Folks,

I am new to this forum, introduced by my EU sister-in-law and non-EU brother.I am studying in Ireland since 2008 and in final year of my business accounting degree. My brother and his wife are living in UK, they hold residence card under the EU Directive since last 7 month. My brother and his wife visited me, early in this month. They liked Dublin a lot. They have planned to move here. My brother have pushed me to have a look that what rights EU Directive gives me as a dependent Family member brother and his EU wife. I am using word "Dependent" because my brother and his wife have been kind enough and they have been supporting me from UK for covering my college fee and expenses. And I am asking this in the context of applying it in Ireland not in the UK, as my brother and her wife are coming to Ireland for this they mentioned that they will get Residence Card from here.

I still hold the valid visa till January 2013.

I am not here to get advises for my brother and his wife that what they should do for their RC here in dublin. For this they will ask you themselves. They seem to have enough info about their rights given by directive because they won their RC in an hearing of an appeal in-front of an immigration judge in UK.

Any comments and suggestion from guys like Directive 2004/38/EC, BEN for me as a sibling of this EU family. As I have seen these two guys very active on this forum.

Cheers
Bil

Fall under category 2(a)

Post by OTHER_EUFamMem » Sat Apr 28, 2012 3:42 pm

Before Starting this thread on this forum I checked out this page of your website. I think I fall under the category of " Article 3 (2) (a) any other family members [...] who, in the country from which they have come, are [either] dependants or members of the household of the Union citizen"

And bit closer to the following case described on this webpage:
"Sister of the non-EU spouse (before getting RC, sister was on student visa in UK and was fully dependent for course fees and living expenses. Sister had previously lived in country of origin with financially dependent parents)"

If i have not got it right, can you please suggest me under which category i fall after reading my StoryLine mentioned in the start of this post. As I mentioned that I am brother (non-EU) of non-EU spouse of EU citizen, who are living in UK and hold RC.

Hard to tell if you got it right or not. This is an area that is not so clear for me.

Describe to me why you think you match this description.

Taoiseach calls on Brady to 'reflect' on Smyth documentary revelations

on 02/05/2012 15:07:26

Taoiseach Enda Kenny said today that Cardinal Sean Brady needs to "reflect" on the contents of a BBC documentary on Fr Brendan Smyth.

The Cardinal has issued a statement to say he feels betrayed that those who had the authority in the church to stop Fr Brendan Smyth from abusing children, failed to act on the evidence he gave them.

Last night's TV programme claimed that information was given to an investigating team of clerics, which included the Cardinal, who was a priest at the time, about other children who were being abused by Fr Smyth in 1975.

However, that information was not passed on to the families or law enforcement authorities.

Responding to the documentary, Cardinal Brady said he had no authority over Brendan Smyth.

He said he assumed and trusted that when the evidence was brought to the Abbot of Kilnacrott, he would deal decisively with Brendan Smyth to prevent him from abusing others.

Cardinal Brady said he was simply a notary, or note taker, in the process but he did not lead the 1975 church investigation.
