eea application refused even after prove of same address

Post by computopia » Sun Apr 29, 2012 9:14 am

Hi,
im eu citizen living in uk since 2010. i met my bf from pakistan here and we lived at the same address since 2010 till the end of 2011. after i had to move because of argues with other tenants in our shared house and my bf stayed because he was contracted to that address. we were still in relationship and i was a regular guest in his house, what his housemates can and did prove. in march 2012 my bf was arrested as illegal emmigrant. we applied for eea, sent a lot of evidence of our durable relationship, statements of our friends, pictures...even the bills covering period from june 2010 till june 2011. his application was refused because they need jointly bill sent to our address. we never paid bills jointly so we are not able to send this document. we lived in shared house so we dont have tenancy agreement. but we have bank statements and other documents showing that me and my bf lived at the same adress at the higher mentioned period of time. is there any option for us, because i think the decision is unfair because i provided evidence we lived together. any ideas what can i do now?
thnk you

The provision for unmarried couples is when there is a durable relationship akin to a marriage. Just being having a boyfriend/girlfriend relationship is not enough even if lasted for long.

More evidence is required that you are in a durable relationship akin to marriage.

You need to live at the same adress in a relation akin marriage.... i applied as an unmarried partner of an EEA national in 2007,and we did provide enough evidences of our live as couple,we sent joint bills, council taxes and the proof that my partner was exercising treaty right.
The first application wasn't succesfull, the homeoffice said that we didn't prove that my partner was settle in uk.we made a appeal and won de case.i have been granted a residence card.
