Citizenship Troubles

Post by valluvan » Sun Apr 29, 2012 10:54 am

Myself, wife and child had gone in March to apply for BC citizenship at NCS.
We had applied under the 5 year(WP+Tier1) and 1year ILR scheme.
The lady said we could not apply for my wife as she was not in the UK on the day in march back by 5 years(i.e March 2007). In fact she had gone back to our home country for child birth and came back only in 2007 oct along with our baby.

So we were told my wife could apply for hers in Oct and we applied for myself and the child. Now when I get my BC(expecting around May/June) can she then immediately apply for BC as a wife of a BC rather than wait until oct and applying on her own?. She's been here in the UK since 2006 Jan, however will still the restriction of being on the same day back for 5 years still apply?

You being British is not relevant. She is already eligible as she has held ILR for 12 months. The issue of her being present in the UK on the same date she is applying (five years in the past) remains.

But is it not that the residency requirement for someone applying as a spouse of a BC 3 years and hence she needs to be in the UK on the same day 3 years backwards and not 5 years??...
