RETENTION OF RIGHT

Post by davidson » Sun Apr 29, 2012 8:18 pm

PLEASE I HAVE TWO QUESTIONS WHICH ARE:

1,
I GOT MARRIED TO EEA FOR THE PAST THREE YEARS AND ONE MONTH AND NOW SHE LEFT ME BUT SHE STILL LIVES IN UK AND SHE ASKING FOR A DIVORCE.I AM SO WORRIED,DO YOU THINK I HAVE ANY CHANCE OF APPYING FOR "RETENTION OF RIGHT"?

2,
IF I HAVE RETENTION OF RIGHT IS IT POSSIBLE TO MARRY ANOTHER WIFE AND BRING HER OVER TO THE UK TO RESIDE WITH ME {WITH THE RETENTION OF RIGHT}?

Goodness, one step at a time!

I'm not aware of any provision for family re-unification for one who has retained right of residence.

Sorry for being sarcastic, but you are not even divorced yet and already thinking on bringing a new wife to the UK?

How "convenient" is it that your wife wanted a divorce just as you qualify for Retention of Rights.

It all could be genuine but it smells like an abuse of the system.

A for your questions:

1. Depends if your wife exercised treaty rights in the UK.
2. Not under the EEA rules. Once you obtain PR (5 years), you can under the UK national rules.
