Unmarried partner visa — Maintenance requirement/docs

Hi there
I am hoping to move from Tier 1 General to Unmarried partner visa when I next apply and wondering if it will be possible with our present financial situation?

I am US living with UK partner for more than 2 years, we have a baby together now. I have been on Maternity Leave since August 2011. Mine was the primary income for the year prior to maternity leave. I start work again 14 May 2012 at a new job, and he is leaving his job to take on child care duties.

Do we need to show both mine and his bank statements for maintenance requirement? I ask because although he has been working, he still in his student overdraft from uni so it probably doesn't look very good. Is it possible to have his parents write a letter stating they help him financially?

Also, does my maternity leave affect my maintenance requirement?

If I am successful with visa application, we want to know if he can claim housing benefit during my 2 year probationary period if it becomes necessary for him? I know this is unavailable to me.

And finally my Tier 1 expires November 2012. How early can I apply for unmarried spouse visa? I would like to apply now if it will make my application more likely to succeed?
