babies visa requirement

Hi

My wife to be and I are planning on having a baby soon. I am currently a Tier 1 main applicant and my wife is a dependant and we both live in uk.

How soon after having a baby do we have to apply for our childs migrant permit?

Being australian does it mean I need to apply for a passport for our baby first and then for a migrant permit?

What if I do not have migrant permit for our child and we travel overseas, what will happen at immigration if both parents have migrant permits and the child does not?

Do we all get turned away then?

there is no obligation to apply for permission to stay if the child is born in the UK, however if you intend to travel then you will need to do so, as the child may be refused entry on return to the UK if she does not have a visa/residence permit. Obviously an Australian national can seek entry as a visitor without applying for a visa but the child would not be visiting so would should not seek entry as a visitor.

if you intend to travel you should therefore apply for your child's leave a PBS dependent before you travel. child will need a passport for this.

So being born here does not automatically equate to permission to stay ... that is a real pain having to apply for our childs PBS dependent and everything else that goes with it.

What do you think would happen in practise enforcing such a rule ... for example we return from holiday my wife and I have leave to remain in our passports carring a baby only a few months old born in the uk, they let us in and refuse entrance to the baby???

I guess they not let all of us or allow the baby to pass undeterred?
