Payment not deducted , credit card expired during the time

Payment not deducted , credit card expired during the time

I had applied for my VISA extension on 3rd April 2012 which reached home office on 4th April . The payment fees is not debited until now. The credit card I used to pay for myself and one of my dependent expired yesterday. My visa is due to expire on 8th May . Home office enquiry office say that an enquiry cannot be started before 4 weeks which is tomorrow .

I am worried about the time this is going to take . With my visa expiring soon will I have problems reapplying .

You took a big risk of using credit card which was due to expire soon. I am afraid the payment may get declined and your application will be returned as invalid. Check with your bank is there anyway to get your card activated for 2-4 weeks? (though i am not sure if this is possible)

I suggest rather than thinking of reapplying and all that, why dont you take a print out (for you and your dependent) of the payment page, fill with the new details and send it to HO along with the covering letter explaining everything. Get their fax number, fax it across once everyday of next 3-4 days and follow it up with the call to see if it has been received.

Being an industry employed, bank can prolonged the card for subscription based payments and there should always be a way of manually allowing such transactions to go through. Worth speaking to the bank

I have checked with the bank and they say its not possible
I will also send a letter to the home office with the new updates

Does anyone know the time it takes for an application to be sent back if it is invalid .

The application should be sent back once the payment is declined and it is tagged as invalid. How much time it will take? can't tell especially with the current delays with UKBA. Even if it is received after your current leave is expired (which is likely to happen knowing your visa expiry is 8-May) you shoudn't be worried; as people on this forum have mentioned that they re-submitted the application in a similar scenario and there applications were considered.

For a piece of mind from payment issues, you may consider to send a bankers draft or postal order when you re-submit the application

spoke a lady at the enquiry dept at home office today and she says i might have to go back to home country and reapply in case the application in invalid and reaches me after the visa expires ..Is this true ?

Every person I speak to at the enquiry dept says different things .I guess they dont have enough info on these things ?

Tier 1 is closed for applications from outside the UK so the advice given by the person on the enquiry line is incorrect.

Tier 1 applications can be made and granted when your leave has expried as the rules do not require that you have current leave as a tier 1 general migrant rather that you have or were last granted leave as a tier 1 general migrant. See 245CA(f)

The problem with applying out of time is that you will overstay until a decision is made and won't get a right of appeal if the application is refused.

However I think in your case, in the event that they do reject the application as invalid after your leave has expired, you should argue that this is unreasonable because you provided valid payment with the application, and 5/6 weeks is an unreasonable amount of time for them to take to process your payment. See also this recent case which may also help you. I therefore think you would have grounds to argue that a subsequent application should be treated as in time.

As was suggested by another poster, I would also suggest sending in another payment form with a valid payment card, send this in by Special Delivery and make sure you include any references numbers that you have and explain in a covering letter why you are doing this. Also call them to tell them you have done this. if they then treat the application as invalid you will have a stronger argument to say this is unreasonable.

I had particularly told the lady at the enquiry office that this is tier 1 extension that we have applied .they said i could not raise an enquiry as they did not have any details regarding the application in their system yet .

the lady i spoke to earlier last week said they will consider the date first applied and give a chance to reapply if the first application was considered invalid

i have also sent a circumstances changes form with cover letter and correct payment details yesterday which should reach today .
With the delay in the processing Im not sure if they will even look at it

they may not look at it but you are covering all bases in the event that the application is processed using the old details after the card has expired.

the processing department are not caseworkers and they won't check to see why your payment has failed so they are likely to say that your application is invalid. just be prepared for this.

When sending updated payment details, is it best to post the payment details to the Durham address or the Croydon address (alternatively, is there a fax number or email address that would work)?
