Need urgent advise ... Please

Dear experts, please note I hold work permit issued in 2008 n expires in nov12. I have a new opportunity from other employer n he has applied for cos for me in 1st week of march but there is no update from home office on same. Meanwhile I want to know if I resign from my current employer n wait for the cos n once issued apply from transfer of visa. Can I leave this present job n wait for the cos from other employer. At present my current employer is harassing me a lot it is a mental torture n I don't want to be with him anymore. I will affect my health due to this. Please advice what should I do. Can I leave n wait for cos. will this break will affect in any ways ... Pls help

Under the work permit, you have to leave the country in 28 days after you resign from the job in the work permit.

So, in your case, if you resign your job but cannot obtain the new Tier 2 application in 28 days, you will be classified as over stayer, which would affect your future application.

I'm not sure if there are special rules for work permit holders in this situation (the old rules are not readily accessible) but if you were in Tier 2 and you resigned, the procedure would be for your employer to report the termination of employment/sponsorship to UKBA following which UKBA would make a decision to curtail your leave to 60 days from the date of their decision and inform you of the curtailment.

In the previous (February 2012) version of the Tier 2 policy guidance there was a provsion that if the remaining leave was 6 months or less it would not be curtailed but this no longer appears in the current (April 2012) guidance.

I m not sure and have no idea if i resign i will have to leave with in 28days. what should i do .... Please let me know if any other solution for this. My new employer has already applied for cos for me but there is a delay in issuing cos from homeoffice.

Ring UKBA Immigration Enquries (0870 606 7766) and ask about the visa curtailment rules in your specific case. You don't have to give your name.

Visa cannot be transferred.

To be employed with the new employer, you will need to make a fresh (new) leave to remain application under Tier 2. The policy guidance explains the RLMT requirements and salary threshold.
