tier 1 general extension

Post by sushma kalmadi » Wed May 02, 2012 11:29 am

Hi,

I have moved to UK and working in UK, I seem to have a peculiar problem, your advice would be much appreciated, my Visa is until Nov 1st 2012,and I started working in UK since 01 October 2011 which is exactly 12 months to my visa expiry, based on my age and salary, I do qualify for my extension, Since I would have to apply for extension before visa expiry-Nov 1st 2012 I would not be having my 12th month payslip nor my 12th month salary credited into my account before my application for extension, which will make me short of the salary to make up my points table by few points, 12th month pay gets credited on 01st Nov 2012, which is the day of my visa expiry,

My question is would 11 Months payslip be suffice along with my Offer letter from my company

can i book an appointment either next day or the same day of my visa expiry date

as long as your 11 months earnings get you considerable points (satisfies minimum earnings requirements AND / OR required points for your extension, you are good to go.

On the contrary, you can not claim ur offer letter as a proof of ur earnings...
Remember, the main thing that is required for your earnings is that ur payment of taxes and NI and these details getting mapped to appropriate NI number.

Your 12 month salary assuming you started on 1/10/2011 would run from

1/10/2011 - 31/09/2012

11 month salary with offer letter will NOT suffice as you have not earned that salary yet and god forbid, anything could happen or could have happened in that 12th Month
An [Expensive] Immigrant journey has ended 19/08/2015. Good luck to you all out there...

11 months earnings is okay provided it is enough to meet the points requirements relevant to you. You would need to provide evidence of your earnings that meets the requirements in place when you apply for your extension. You might want to look at the current guidance notes to give an indication of the types of evidence needed. An offer letter isn't acceptable because it doesn't show what you have actually earned.
