Recently won appeal for fiance in India - what happens next?

Post by sqaush » Thu May 03, 2012 2:56 pm

Hi

I had to attend a court appeal 19.3.12 for my Fiance who's visa was initially refused last year.

3 weeks after this, I received confirmation that I had won the appeal and my Fiance would be granted the visa. I understand that the UKBA then had 28 days to appeal the judges decision. My solicitor contacted the UKBA who confirmed that they were not going to appeal.

My question is what happens next? Does anyone have any experience of this?

I want to know when my Fiance is going to physically receive his visa. How long does this process usually take?

Do you know who I can contact to find out e.g. is it UKBA, BHC in India or VFS?? I'm confused as to who is dealing with it now.

I would be grateful for any advice. Many thanks

@sqaush,

where is ur fiance located?
congrats for winning the appeal... let me get this correct, UKBA has 5 working days to appeal against the decision made by FTT...

frm here on, the same decision wld have been sent to the Embassy where ur fiance is located... email the embassy and ask for the call letter.. at times, they just go off to sleep...

hopefully, u'll recv ur call letter soon in which they'll ask ur fiance to come and submit the passport for visa... VFS has no role to play in terms of visa...

I'm assuming, its delhi u r talking abt, so the email address for them is Visqry.Newdelhi@fco.gov.uk

only these people can help u now...

Thank you very much for your reply Lucy :-)

Yes, it would be the embassy in New Delhi. Thank you for finding out the email address!

Do you know if they will send him the letter by post or by email? The reason I'm asking is because my Fiance doesn't have a postal address so he had to give a friends address and we just want to be prepared.

Hi again Lucy!

I just noticed the dates at the bottom of your reply. You received the call letter very quickly!! Was yours applied for in India too? I wish ours was being dealt with so fast.

Congratulations on your success too! :D

i went mad in 7 months.. :( u r saying its quick...

actually wat happned was, as soon as my husband recvd the determination letter, i started emailing visa section in new delhi every now and then aftr those 5 days passed on for them to appeal....
in response, they sent me the call letter in email and asked me to tk print out of the call letter and directly come to the BHC, Shantipath... dats why it sounds quick...

honestly speaking, they have no set method to send the call letter.. in this forum i guess chimpee directly recvd a call to come n submit passport... n i recvd in email... though whn u'll write to them, u can raise this issue and probably they might just send u in email....
