Hi All,

I'm in the UK on an old-style work permit, which is valid through August 2013. I have been offered a position at another institution with a CoS start date of July 1, 2012. I applied for a Tier 2 visa (in country application) on April 1, the first day I was permitted to apply. But at this point I don't even have my biometrics letter, and it is looking increasingly likely that I won't even get my visa by July 1. I'm confused about what happens then. I know I can't start working for my new employer until I get the visa, but can I continue working for my current employer until the new visa arrives? Or am I obliged to stop working for my current employer by the start date on my new CoS, even if I can't work for my new employer at that point?

any advice very welcome!

You can continue to work in your current job.

That's great, thanks. I called Talent Scotland and got the opposite answer. Surprise surprise. Not sure what to think. (I can't help but think you're right and they're wrong, but it's disconcerting to think the person paid to hand out advice to people in my situation doesn't know what she's talking about!).

Lucapooka is right, Talent Scotland is wrong.

The simple reason is that until your current visa is cancelled or curtailed your immigration status is as per your current visa and associated CoS, and these are specifically for work in your current job.

Thanks for this. I actually applied online on April 1. I received my biometrics letter on April 13, but the person who processed it inexplicably introduced a typo into my name. That very day I called to request a new one, but it has yet to arrive. I'm not sure what is going on. I called about 10 days ago and was told that the caseworker processed the new request on April 23. Not sure why it hasn't arrived yet, but it seems a bit ridiculous.

The timelines thread makes for grim reading.
