Spouse Visa FLR (M) application

Post by sam2106 » Fri May 04, 2012 4:32 pm

Hi there...

Am hoping you guys can help me with sections of the FLR (M) which I am not sure if these should be filled or not.

FLR (M) Version 04/2012
Quest 1:
I have a question here referring at page 18 Note 6 ( If your partner is a non-British citizen without a passport, you must provide a Home Office Letter showing that he / she has been granted indefinite leave to enter in the UK, accompanied by at least one other formal document of evidence of ordinary residence in the UK for the last 3 years. the following are examples of formal documents that may be provided as evidence of ordinary residence for the last 3 years: notice of income tax coding, driving license, British license, building society savings books / bank statements, National Insurance or National Health Service registration issued by the Department for Work Pensions and Local Authority )

Does this mean after receiving my long awaited passport, I don’t have to send it back to home office again for my wife FLR(M) application...does it mean I can only send ILR letter and documents to prove being an ordinary citizen for last 3 years as it mentions above? It yes, possible, I would like to ask how many documents I have to produce to them? Does it have to spread over the 3 years? Please explain to me this confusion (please note am trying to avoid having to send my passport once again to the Home Office as I might need it to travel with work mid of June - am currently waiting for my passport back from UKBA applied for indefinite leave 10 years long residence on 27/02/2012).

Quest 2:
section 1.4 ask for applicant full name: I would like to know is it in the format first name / middle name / surname or first name and middle name only as section 1.5 ask for surname again...

Quest 3:
section 7.1 ( did you get an entry clearance as a spouse, civil partner, unmarried or same sex partner, fiancee or proposed civil partner before entering UK? ) what does she has to answer here please? is it yes or no?

BACKGROUND INFORMATION

My unmarried partner is currently dependent on my Tier 1 (general) expiring 20th May 2012.

I have posted my ILR in the category 10 Years Long Residence on 27/02/2012. Currently, I am still waiting for my passport and ILR and I don't think I'll be getting this before 20th May anyway.

Therefore we posting the FLR (M) unmarried partner application next week and will ask home office to either to liaise with ILR department with regards to my ILR application so that they can process my partner's FLR (M) in parallel...Or alternatively take immediate payment for FLR (M) application fee of £561 and keep hold of her case until I will immediately forward my passport + ILR which once received...

I haven’t tick the box page 18 on the top and instead in the box I have explained the above situation with my passport

Please note As part of her immigration background, She was in the UK on student visa previously when we started living together...then she converted to tier 1 psw...afterwards when her tier PSW were finishing ..She could not apply directly in the UK to become dependent on my Tier 1 (general) . We had to go British High Commission back home where she was allowed apply for dependant on my tier 1 (general). Thus she was issued new entry clearance visa based on unmarried partner of Tier 1 (general)
