so let me explain it .his wife is Spanish and he is Algerian .they both applied for EEA1 and EEA2 .but today they received 2 document saying:
so basically they are asking my wife for evidence of exercising treaty rights in the UKunfortunately the submitted document are insufficient to establish that your client has the right to reside under 2006 regulations as outlined above .I am therefore returning the application and the document with this letter ,this letter who indicate what additional document /evidence your client need to provide ,should she wish to reapply for registration certificate a further application can be made using eea1 application form available the UKBA website.......
Please note that this is not a formal determination of your clients status under the regulation .our purpose in returning the documents is to to enable your client to assemble a complete dossier supporting evidence and to submit this with a fresh application when she is in position to do so .in the meanwhile we will not be giving any further consideration to yor clients case.
my wife used to be employed part time as well as being self employed .the documents I sent were self employed assessment, few bills from HMRC and few payslips dating from last year in which there is only 16 hours a week. Also a confirmation from an accountant which states that he is dealing with her tax returns.in her bank statements show that she was getting support from her parents and there have been regular transfer every month. therefore she is also self sufficient .
at the moment she is working full time as a nanny and getting paid cash in hand.but we are looking to submit her taxes at the end of this financial year in October.so what steps should I be taking next? and If I am missing anything what would it be please?
thanks in advance and I would appreciate your help very much .
warm regards
