Do I qualify for ILR?Please advise.

Dear Moderators/Gurus/Experts

I came to UK on Tier2 ICT Established Staff in Oct 2010
Switched from Tier2 ICT to Tier2 General within the UK in Jan 2012
My current tier2 General visa is valid until Jan 2015

My continuous period of stay in the UK so far is -

18 months on Tier2 ICT+ 4 months on Tier2 General -> 22 months

However my question is that does the period spend on Tier2 ICT Est staff visa count towards 5 years of continuous stay in the UK in order to qualify for ILR?

Kindly advise.

You are eligible for ILR in Sept 2015. You will have to make an extension of your current leave to complete your qualifying residence period.

I am a little confused as Para 245HF. Requirements for indefinite leave to remain under Immigration rules part6a reads -

(c) The applicant must have spent a continuous period of 5 years lawfully in the UK, of which the most recent period must have been spent with leave as a Tier 2 Migrant, in any combination of the following categories:

(x) as a Tier 2 (Intra-Company Transfer) Migrant, provided the continuous period of 5 years spent lawfully in the UK includes a period of leave as:

(1) a Tier 2 (Intra-Company Transfer) Migrant granted under the Rules in place before 6 April 2010,


As my Tier 2 ICT was granted after 6 April 2010 can i still qualify for ILR in Sep 2015? Please advise.

unfortunately no because you entered the UK after April 2010

You can only switch to Tier 2 General in-country if your are T2 ICT Established Staff at present or you got your T2 ICT visa before 6 April 2010 AND you are changing sponsors.
