Post by mark davies » Sun May 06, 2012 5:52 pm

Hello all,

i am married to a British Citizen, we got married in december 2009 in Ghana 2009 my settlement visa was issued on the 18/10/2010, i entered the U.K on 2/11/2010 the visa expires on 18/1/2013 please i will like to know when its best to turn in my application, some say 28days before my visa expires others say 28days before the 2 year mark of living in the U.K. I will appreciate it if someone could kindly clarify this for me.

Please note that i will be using the PEO only just incase you need these information in order to aid the calculation.

Thank you so much for your replies.

If your date of entry to the UK (as the spouse of a BC) was 02/11/2010, then the second anniversary of date of entry would be 02/11/2012. So, thereby the earliest you can apply is 28 days before 02/11/2012. The latest would be the current visa expiry date (18/01/2013).

You may find the following link useful for further information: http://www.immigrationboards.com/viewtopic.php?t=79378

Q - What is the earliest day I can apply for ILR?
A - One can apply no earlier than 28 days before the 2nd (family route) / 4th (HSMP before 03-Apr-06) / 5th (other economic migrants) anniversary of either date of entry in the UK (overseas applications) or date of switching (in-country applications). In all cases, one must apply for ILR or for another visa before expiry of current visa.
Use the date calculator to ascertain the "28 days window".
