most suitable likely to succeed visa for our circumstances

Post by Tarkwell » Sun May 06, 2012 6:00 pm

I am from the UK and am in a relationship with a Colombian lady, she has just returned to Colombia at the end of 2 years study visa's. We have been together almost the whole 2 years in a committed relationship and are very keen for her to return to the UK as soon as possible.
I have been separated for 3 years but have not divorced my wife yet though am trying to move this forward unfortunately she is uncooperative.
a visa allowing work would be ideal though I can support her and receive no state benefits.
Marriage is probable in the future but we don't want to be forced down this route early just to get her a visa.

Hi,

You have implied a question, but not asked a question.

I think you should go ahead and ask the question clearly rather than people inferring a question from your statements.

Kind Regards

OK for those unable to work out from my previous post I am posing a question....which visa would be the recommendation of the experienced/qualified persons reading these messages.
Thought that was pretty clear from my previous post but hope this clarifies everything to those who were confused.

Rudeness will not help you get an answer.

She could apply for a work related visa under PBS . There is no visa for persons dating so your relationship with this person will not be a route for her to enter until it is either formalised by marriage or a clear intention to marry or you go to her and live with her for 2 years in a relationship a kin to marriage. You will of course need to divorce your current spouse.

Just a point of clarification to penniless' post- it is not necessary to be divorced to apply for the unmarried partner visa providing you can show two years cohabitation and of course can show your marriage has broken down.

As a point of interest....Unmarried Partner Visas were originally granted as a concession to those who were unable to divorce due to the law in their own country. The Philippines for example. It was later extended to all unmarried couples who could prove a minimum of 2 years co-habitation in a relationship 'akin to marriage'.
