Need clarification on 245HB. Requirements for entry clearanc

Dear Forum Members,

I am currently on Tier2 ICT Short term visa valid until 3rd June 2012.My spouse is currently in the UK on Tier2 General.

I am planning to apply for a Tier 2 General dependant visa from India in end of May so that I can join my spouse in the UK.However I got a bit confused after reading the below rule -

As per 245HB. Requirements for entry clearance "(g) The applicant must not have had entry clearance or leave to remain as a Tier 2 Migrant at any time during the 12 months immediately before the date of the application, regardless of whether he was in the UK during that time."

Please clarify whether the above statement holds true in my case or not as I want to apply for Tier2 General Partner/Dependant from India before June 3rd. Thanks

The clause you quoted from the Immigration Rules applies to migrants who seek entry clearance in Tier 2 General. It does not apply to dependant entry clerance applications.
