need urgent help regarding ILR application from Tier 1 Gen

Hi,

I got the HSMP visa on 16th Oct 2007. entered into UK on 29th Nov 2007. thn I got the extension for another 3 years as Tier 1 general which will be expired on this oct 16.

But I was bak in my country over a year back. 30th December 2010 after living in London for over 3 years for personal reason. I am in my country now but went to UK twice by this time. I didn't cross 6 months at a time. I entered twice uk 4/5 days before 6 months. I was in london for around 3 weeks last year June/July and was in london for 3 months and 1 week this january.

Now I am in my country. I am planning to come back to uk before my visa expires. and wanna apply for the ILR or extension whatever I can.

Can anyone suggest me the best way to get the ILR/extension?
Will I get the extension?
As I m outside uk for long time, so naturally I can not show any earning in the UK.
what do I need to do and how do I get it?

Any best suggestions pls...

It would help if you could list each of your entries into the UK and departures from the UK, with dates to get a clearer picture of whether you meet the requirements for either ILR or an Tier 1 extension.

Specifically for ILR eligibility the dates would be a key factor.

thnx for ur advice. i have the dates of in and out...
as far as i know for ILR u can not be outsdie UK for more then 90 days at a time and more then 180 days altogether....
i have broken both rules....
I was outside uk continuously for almost 6 months (3/4 days left)....
and altogether I am outside uk for more then 1 and half year....
so shud i apply for ILR or extension....?

They clearly stated that you do not qualify for ILR if you have not spent 5 years continuously in UK without any legal breaks. You broke the break rules. So as you said, the only other option for you is extension, I am afraid.

i happy as long as i get an extension....but i have spoken to one lawyer and he said there is no 2nd extension for HSMP....means once i got the HSMP for 2 years, i got an extension after tht for another 3 years....nd he said doesn't matter u qualify for ILR or not but u hav to apply for ILR....cuz there is no application form for 2nd extension in HSMP-Tier 1 General....
do u know anything about this....?

You may apply for extension as many times as you wish. Applying for settlement (if one qualifies) is a choice, not a compulsion.
