Hi All,
My query is on ILR eligibility - continious stay by combining tier 1 and tier 2.
In the beginning I was having a Tier 2 (ICT) and subsequently switched to Tier 1 (General). My Tier 2 (Intra Company Transfert) was valid from 10.03.2010 - 27.03.2011, I came to UK on 22.03.2010. On 05.01.2011 I switched to Tier 1 (General). I am Still working for the same employer.
I need to extend my Tier 1 before 05.01.2012.
My eligibility for ILR (Indefinite Leave to Remain) which requires 5 years of continious stay in UK, depends on following 2 situations:
In case of Tier 2 (ICT) + Tier 1(General) my 5 years complete on 22 March 2015. i.e. I become eligible for applying ILR
In case of only Tier 1 (General) my 5 years completes on 05 January 2016, i.e. I become eligible for applying ILR
Following are my questions:
1. Can I combine my Tier 2 (ICT) (issued before 6th April 2010) with my tier 1 (General) to Apply for ILR? I am unsure on this , found some reference in below link.
Reference:
245CD. Requirements for indefinite leave to remain [pt. para (c) subtopic (viii)]

2. In case I cannot combine Tier 2 (ICT) and Tier 1 (general) and If I apply for my tier 1 ext. in december (I may fall short of 5 years by Few days (10 - 20 days) as I believe the visa start date is extended from date application is processed which may be earlier than 05.01.2012. How to avoid that? I wish to avoid another tier 1 extension.
3. In case Combining Tier 2 (ICT) + Tier 1 (General) is possible, what would be the impact of my eligibility in case I change my Employer?
Thanks in Advance.
