Surinder Singh rights for disabled UK National with Non EU

What if a British National has a Non EU Spouse and wants to move back to the UK with his Non EU Spouse and is living in one of the EU countries and wants to work but is unable to due to disability reasons. Is there no disability rights law that if a person is disabled and can not work can the be discriminated against by not being able to exercise his/her EU treaty rights maybe?
