In order to qualify for ILR, the applicant must ensure that on the day of the PEO appointment they have completed at least 5 years continuously in the UK.

Would i be able to qualify for ILR if i get the visa on 21th May 2012 so my total turnover would be:

17th June 2012 untill 20th May 2014..

When can ie b able to qualify for ILR ?

The extension would be from the date of the PEO appointment, which in your case would be 21/05/12.

Hi There,

Thank you for your email.

I have now managed to get the appointment of 21st May 2012.

So would that still be an issue for me as I am now applying within 28 days of my expiry date i.e 17th June 2012.

If someone apply within 28 days then would still he/she be getting the new extension from the date of application or the date of expiry ?

An application at a PEO is decided, where possible, on the day, therefore the grant of leave would be from the date of decision. If this means that the applicant’s date of extended leave leaves them short for the 5 year residence requirement for ILR, then they would need a further extension of leave before applying for settlement.

Dear UKBA,

I need to ask one question which I am very confused about.

I did get my Tier 1 (General) on 17th June 2009 and its expiring on 17 June 2012

I have an appointment of 16th May for Tier 1 (General) Extension.

If I get the visa on the same day which is 16th May then my new extension I would assume would be until 16th May 2014 or would i get the extension from 17th June 2012, the day my visa expired.

So that means My Total Tier 1 (General) Period would be below if i get the extension from 16th May 2012

17TH June 2009 Until 16th May 2014

My Question is would there be any problem with ILR for me ? ( Do I qualify for 5 years ) ?
When can I be able to apply ILR, in which month ideally in 2014 ?
