Will my wife be sent back to Peru because I claim benefit ?

Post by KERNOWWW » Wed May 09, 2012 12:29 am

Hi I am a English born male who married a Peruvian in Peru , moved back to the UK had a child here.

We have been here 4 years , completed 2 spouse residence permit visa and now applying for the Indefinite leave to remain.

However we are stuck on this form where it asks about whether we have taken public funds

Basically I have received house working tax credits and housing benefit to help us live with our child in my country I dont see why I wouldn't be allowed to receive this. However the tax credit guys have my wife name on the form although its in my name first they wanted my wifes name also.

Now what will happen when we now apply £991 for my wifes right to remain?

We both work but also get help with funds - are they going to send my wife back to peru leaving me and our daughter here?

Please help
Kindly
Dan
