ILR or Extension of dependants ?

Post by zeevirgo » Wed May 09, 2012 9:27 pm

Hi

I need advice regarding this if any one can help.

My uncle's family:

Uncle is british and shifted in UK from Hong kong on 1st of august 2010 with wife and 2 kids (over 18 )

wifes visa stating ( Visa settlement spouse /CP (KOL REQ) ) valid from 04/03/2010 till 04/06/2012 ( came in uk on 1/08/2010)

child 1 over 18s now ( visa to join father) valid from 03/04/2010 till 03/07/2012

My questions

what my uncles wifes option to extend visa or ILR as she is not cmplted 2 years yet
what does this means stating in her visa life KOL REQ?
does she needs to do Life in uk test?

what about children wat option they have same do they need to do life in uk test?

thanks

The wife has never been required to complete two years of residence and has been eligible to apply for ILR from the day she arrived in the UK (but only on the basis of her passing the KOL exam). If she has not taken the KOL she should do so and apply for ILR.

KOL REQ is a limited leave to enter settlement visa endorsement, but waives the 2 year residence requirement when the KOL has been taken.

The child who is under 18 can apply for ILR jointly with the mother (no KOL necessary)
The children who is over 18 can apply separately for ILR using SET(F) (no KOL necessary).

It's also for other dependant relatives over 18.

I understand that SET (F) is not for children who came to the UK as dependants of a spouse visa holder and later turned over 18. In such circumstances the form to be used for settlement is SET(o). If I am wrong please correct me.
