A Query for my friend

Post by ITGraduate » Thu May 10, 2012 3:52 pm

Dear Guys,

My friend will apply for his ILR in october this year. He is currently on Tier 1 visa.

His wife is currently on Tier 1 dependent visa. She came to UK in Jan 2011.

My query:

so when my friend applies for his ILR in October 2012, Can he add his wife as dependent so that she also gets ILR with him?

If this is not possible( i think could be because she hasnt completed 2 yrs in UK by october 2012 ) can she extend her tier 1 dependent visa?

Many Thanks,

Assuming "Tier 1" to be "Tier 1 (General)":

1. No (319E(d)).
2. Only if your friend applies for Tier 1 (General) extension. Else, is he applies for settlement then she will need to switch to FLR(M), and then apply for settlement as and when 287(a)(d) is met.
Life isn't fair, but you can be!
