Tier 1 to spouse visa

Hello,

I am currently in the UK on a Tier 1 Post Study Work visa that runs out in Feb 2013. My partner and I have been living together for 2 years, but we don't have any joint accounts etc. Next month I am going to go back to my home country to work for a year (it has been difficult to get a job in the UK on my visa and I need the money/experience).

We are going to get married soon, but we are not sure whether to apply for a spouse visa now or wait until my job is over and apply then. My partner is going to begin a university course (he is a mature student) that requires a year abroad (sept 2013 - june 2014), so this complicates things.

Should we rush through it now, or will our being apart be a problem?
Or should we wait, only to go through the process of applying from abroad and not having been together? Thanks for your help.

As the two of you are not going to be living together in the UK for the next two years it seems then i would say applying to switch to leave as a spouse would not be appropriate and you also wouldn't fulfil the requirements for ilr two years later.
