EEA family permit for OFM of an EU National

Hi Guys,

I am a younger brother to an EU Citizen (British) who is intending to exercise his treaty right in Ireland under the Directive 2004/38/EC. I am dependent on him financially and i've been part of his household in the UK for one and half years before returning to Nigeria. Now, i want to apply for an EEA family permit to join him in Ireland under Article 3(2) of the Directive for OFM (Other family Member). He is yet to exercise any treaty right in Ireland as he has a grace period of 3 months. I want to ask: 1. Can apply for an EEA Family permit in the category of OFM (other family member) as he is yet to exercise any treaty right? 2. What document do i need to prove that i'm his younger brother?

Birth certificates demonstrating common parentage.
