Hello, I wonder if anyone can help me decide. I was initially expected to be assigned an unrestricted CoS and switch from Tier 4 into Tier 2 back in April. However my sponsor only applied for the licence on 15 February and got the e-mail about the licence approval on 04 May and login to SMS only on 9 May, I had already left the UK by then, as my Tier 4 leave had expired in April. The RLMT had been completed in April. So now I need a restricted CoS to apply, I’m trying to explain to my employer that the restricted CoS request needs to be submitted ASAP, and supplied all the details that needs to be copied and pasted into the SMS, but they have been busy and stalling it for almost a week now. My SOC code is 3543, so it is according to new rules in force from 14 June under NQF 4, not under “graduate occupations” as before. I only have a chance to apply if I apply on 13 June.
I have 3 questions:
1. If, hopefully the request is finally submitted today or tomorrow, with the letter requesting CoS exceptionally, what is the chance to get an exceptional allocation still in May, i.e. before the next round is considered on 11 June? Do they frequently approve urgent requests, and what we can put for reasons, except for disruption of work pattern since April already caused by Sponsor Licence delay?
2. If the application is not approved for May, but only granted in June allocations, what is the chance of getting it exactly on 11 June? I have seen somewhere that UKBA ” informs” the Sponsor within 5 working days from the 11th only, i.e. if successful, can the CoS be granted on 14 June or later?
3. Further point – I understand that the old SOC codes before 14 June are valid if an entry clearance is applied for up to and including 13 June. Can the date of entry clearance application be later than the date of CoS assigned? I.e. the date of entry clearance application is the date of online application and payment, and online application does not require CoS number, the appendix with job details has to be printed and submitted by hand before the appointment in visa centre. So I can technically apply and pay for the entry clearance now. Question is – if in the worst case scenario the CoS will be granted and assigned only on or after 14 June – will my entry clearance application still be considered valid if I only submit the supporting documents on or after 14 June? Will it not be the grounds for refusal?
If I don’t stand a chance with the above, is the only option left - choose another SOC code from NQF6 and for the employer to start the RLMT again, and after that again apply for CoS?
