What SET forms do will need?

Post by kjkj » Mon May 14, 2012 11:09 am

We are now looking at which SET forms we need for My wife and her son (aged 13) and her daughter aged 19. We are wanting to apply for ILR but are a bit confused as to which SET forms we need to apply.

Also, cannot apply before 28 days of expiry of spouse visa.....is this the expiry of the 2 years or 27 months?

Please provide fundamental background immigration information to help people understand the query and respond appropriately.

1. What is the immigration status of each of the persons in question?
2. When did your wife and her children first enter UK as spouse (and children) of a British citizen or settled person?
3. Was the daughter, now 19, a minor when she was issued entry clearance as child of British citizen or settled person?

to clarify:
1. my wife (and 2 children) entered the UK from Thailand on a spouse visa, as a spouce of a British Citizen, which means they have leave to remain in the UK for 27 months.
2. my wife and her 2 children arrived in the UK on 16 May 2011, as spouse and children of a British Citizen.
3. her daughter was a minor when we got her visa, but was just over 18 when she entered the UK. She is now 19 and will be just over 20 years old when we apply for Indefinate Leave to Remain.

SET(M) for both wife and minor child. No earlier than 28 days before the 2nd anniversary of their entry in the UK.

Not sure if the 19 year old daughter can apply for settlement, so wait for others to respond on that.

Thank you for your expert replies. Im feeling a little easier but still not 100% sure about SET (F) for my step-daughter. Could it be that she should apply on SET (O)? Obviously I would prefer SET (F) purely on cost. Sorry to want double check but I have some conflicting information.

A correction that I must make........it seems that if my step-daughter is to apply under SET (F) the fee is £1850 without the option of applying by post! It seems there is no cheaper option. It also means that my whole family must apply by post because the applications must be processed together.

Is my understanding getting clearer and near to the true facts?
Thanks

Hi vinny and thanks. I will await for a written confirmation re SET (O). There is some uncertainty out there even in Immigration Dept. My step-daughter came here with her mother (my wife) after her 18th birthday but was greanted Settlement Visa BEFORE her birthday. She will be 20 year old when we apply for my wifes ILR (SET M). Immigration says that we should apply at same time but using SET O for my step daughter. However, SET F pops up from time to time in forums!
