Tier 1 to ILR Dependent

Post by tushars » Mon May 14, 2012 1:40 pm

Hi All

Need some advice here
My wife is currently on Tier 1 and will need to renew her Tier 1 once more after an year (falling short by 6 months for 5 years to ILR) to get ILR on her own Tier 1.

Is it possible for the wife to apply to be my dependent (I have ILR now, after being on WP, Tier 1 for 5 years, we have been staying together for 4 years now).
If yes , what status will she get? ILR / ILR Dependent?
Also can she then apply for citizenship after one year of getting ILR/ILR dependent ?

Any suggestions or a pointer to existing topic will be helpful.
We are trying to find a way which will help us save some money and not delay her ILR.

cheers

Yes. Leave to remain as spouse of a settled person.

No citizenship without ILR. And your wife applies for FLR(M) leave, as above, then under current rules she will be eligible for ILR only after living in UK for at least 2 as spouse of a settled person.

If the aim is get your wife settled status as quickly as possible, she should take call on which route to take depending on when she becomes eligible for settlement as a PBS migrant as compared to 2 years (currently) from date of issue of FLR(M) leave if she switches.
Life isn't fair, but you can be!
