No Recourse to Public Funds

Hi All,

I am on Tier1 General and as everybody knows Tier1 General migrant can not avail public funds. This also includes city council's housing which a Tier 1 General migrant can not apply for.

My question is, can i apply for private housing associations which are partially funded by city council/government.

Some of the examples of these private housing associations are;

Homehunt - http://www.homehunt.info/
Langstane Housing Association - http://www.langstane-ha.co.uk/

In case of yes/no, is there anyway this can be verified?

Normally in housing if we register someone on choice based lettings then before going any further council/ Housing association ask for residency status. If they are registering you without any hassle then why not.

But it really depends. I am senior housing officer but cannot apply in my own housing association until i get ILR.

The housing association registered me & my wife without asking any question about residency status etc. My concern is they might send our details to government bodies/city council after we accept their house; telling that they have provided us accomodation. Since these associations get budget from government i wonder if this comes under public funds.

This thing might create problem at the time of ILR.

This is very confusing and i am really concerned as i thought i have an option to apply for cheap house through such co-operative housing association and now thinking i might not be eligible to apply for due to public funds restrictions on my visa and i do not want to get any problem at the time of ILR.

Yasa, since you are the senior housing officer and you mentioned that you can not apply for a house untill you get ILR.

Which factors are forbidding you to apply through such housing association? Also, if you can please advise which factors someone should consider before applying and accepting offer from such associations?

The main factor is that most Housing associations have to give certain properties to council on subsidised rate for affordable housing but this is only for people who are entitled for public funds/Housing benefits etc.

But in my opinion any council will not offer unless they confirm the immigration status, if after that they still offer you then you dont have to worry at all.

I also work in Housing (council) and have done for many years.
Virtually all Housing Associations now have their properties allocated via the choice based lettings scheme, this means you have to apply via your local council and if you do not have ILR then you can not apply to go on the list.

I know of no housing associations in the county I live in that allocate outside of the choiced based scheme, but there maybe others outside of our county who do.
As far as I have always been aware Housing Associations are classed as social housing so it should also be classed as a public fund, maybe wrong on that though.
