Move from Tier 2 to unmarried partner of ILR holder

Post by dawnleipold » Tue May 15, 2012 8:31 pm

Hello,

I've been in the UK on a Tier 2 visa for 2.5+ years which is up for renewal by my company in September. My partner has been in the UK for 6+ years and currently holds ILR and will be applying for citizenship in October.

I'm interested in switching away from my Tier 2 due to work instability, and over to the unmarried partner of an ILR holder.

First - I believe this isn't an issue but want to confirm my understanding.

Second - Is an unmarried partner considered a dependent?

Third - Will there be any issues if I switch in the coming months, and he applies for citizenship a few months later? Will I need to re-apply with him or will it automatically switch over so I'm the unmarried partner of a British citizen?

(As a note - I hold an American passport and him New Zealand, and we've been living together in a relationship akin to marriage for over 2 years).

Thanks for anyone who is able to provide me with some clarity.

Kind Regards,
Dawn

1. No.
2. Don't understand the question.
3. If your partner becomes a British citizen when you are on FLR(M) leave, you don't need to do anything until you wish to apply for another extension / settlement.

FLR(M)

Sorry to moderators for putting this in the wrong category!

Thanks for the response sushdmehta. Don't worry about the dependent issue.

As far as I can see, being the unmarried partner of someone with ILR / citizenship doesn't restrict my working - am I correct?

Thanks again,
Dawn
