EEA family permit

Hey , i have been together with someone who is a visa national that is living in belgium for now, for 2 years , we met three times in belgium and have got married recently , we have many proofs that what we have is genuine such as.. photos, daily calls , txts, letters,cards,Emails, gifts, money transfer proofs from both sides .... he tried flying to me illegally last year and was stopped by HO and he did not want to tell them the reason he was flying for and his right name and nationality being carefull of deporting him, but at the end he told them , then HO said that he was not allowed to apply for any kind of visa to UK for a year that has finished now , what i would like to ask please is .. can we apply for the EEA family permit even if he tried entering the UK illegaly knowning that he was told by HO he was not deported when they removed him just sent back to the counry where he flew from wich was belgium, and does it count it was deception to enter the country when he did not say his right natinality in the beginning ?! and 2d question please is .. can we apply for this permit even if we did not live together before ?
