Universities that I applied to for a part-time Phd were in the dark to say the least. Universities either give a Tier 4 visa or a home student status(UK and European citizens). Hence you should contact the institution first to confirm if they will let you be a part-time student when you are a full time resident of the UK and yet not a UK citizen.
You would be charged an international fee till you get the ILR.
Best wishes.

thanks for quick response, I have been living since last three years in UK under same Tier 1 Category, should I be charged with home fee or overseas?
Would appreciate your help. Thanks.
You would have to pay overseas fees. The International Student Office of the university would confirm that with you
