I have a situation that i don't know how to deal with. I and my family came to UK in October 2004 as WHM, our visa was due to expire on the 24th of August 2006 but i applied for the HSMP on the 16th of August and requested for an urgent treatment of my application. The decision was taken on the 30th of August which was a week after our visa expiration and i was refused.
However, the decision letter and my documents were not returned to me until 15th of September and i was given a 28days to request for a review of the decision.
I decided to re-apply rather than review and my application has been approved. The only problem i have now is how to go about applying for the visa as i realize that it will be difficult for me to apply for the visa as an in-country applicant as my leave to remain has expired.
I am scared of leaving as i would not want the embassy in my country to use this against me in denying me the visa and also don't know what i could expect at the port of departure.
Kindly advice me on what to do as am really confused and will like to legitimise my stay in the UK.
