Main applicant Tier2 applying for ILR but partner can not

Hi dear I will really appreciate if some body can help me out here. I am main applicant tier2 and will complete my five years in two months. I will be applying for ILR in August. My wife has not completed her two years. My understanding is she is not eligible for ILR with me because she has not completed two years as my dependent. She can also not use FLR (M) for further extention because that is for people who are settled or British and unfortunately I can not find any other form suitable for her.

Please suggest what to do in this case as I will be sending my ILR application in post ( in person appointments not available) and they may take upto six months and my wife visa will expire in just after 28 days even if I post at the earliest date. She will be left with expired visa and I am not sure if she would be legal to stay in this country after her visa expires.

Please suggest. Help will be greatly appreciated.

Which you will be when you are granted ILR. She applies using FLR(M) in a bundled application with your SET(O), requesting hers to be considered in series, on the basis of your success.

Thanks for your answer it was indeed helpful. I was looking at the Set O and FLR M forms. Both are to be posted to different address in Durham. I was wondering if it would be OK to post FLR M with my SET O to the address notified on SET O.

I shall be thankful for your answer.

Yes, favour the SET (O) address. When you say different addresses you mean a different PO Box at the same address.

Hi Thanks for your time once again.

They have asked to post FLR M at a different post code in
Durham which I think is a different address in Durham than the one mentioned on SET O form. Shall be very thankful for your answer.
