ILR For dependents - please advise

I came to UK in july-07, Recently I got the extension of Tier 1 General for myself, my wife & UK born Child as dependant with visa expiring in Jan-2014.

As I am completing my 5 years in July-12. So to apply for ILR My questions are:

1: Should I apply for ILR of my UK Born child as well along with me or I can apply for his British citizenship directly when I will apply for BC after one year of my ILR?

2: Can my wife also apply for the BC with me, after my eligibility of BC (1 year after my ILR) without first getting her ILR. As I will be eligible for BC in July-13 and her visa is until January-14.


Please advise me, if it is possible I can save some £££.

1. You can skip ilr for UK born child if you wish and apply for child's registration as British citizen once you have ilr-see FAQ you don't need to wait before applying for citizenship yourself indeed this would not be advisable as your child would not have valid leave in the UK.

2. On your wife would need ilr in order to apply for citizenship.

Hi

Your wife will apply for ILR alongwith you. As soon as you guys get your ILR, you can apply for the citizenship of your uk born child.
Your wife can apply for citizenship alongwith you only if she gets ILR with you.

Even if my child has the dependent visa of Tier 1 G until Jan-14, will that become invalid when I will get ILR and can he not travel by having that visa ?

Correct. Visa becomes invalid as he can't be a dependent of a visa you no longer hold (even if the expiry date is 2014).

no -he is no longer the child of a tier 1 dependent so could be refused entry on return to UK. If you want to travel soon after your application then the child should be include in the application.
