Convert wife to Dependent visa?

Convert wife to Dependent visa?

Hi,

My wife currently has her own independent Tier 1 visa and I am on my own Tier 1 visa. She is with me in the UK but I had arrived 6 months prior to her.

Because she came in the new rules, she may struggle to get the required earnings for an extention.

I am due for an extention and I have made the points.

Is it beneficial to convert my wife's visa to dependent?
If 3 years down the line, I apply for ILR, can we both get ILR together?

If she may not be able to extend, then the question about benefit is irrelevant - if you both wish to stay together in UK.

Yes.

But she cannot "convert to dependant" from within UK. She will need to apply for entry clearance (from outside the UK) .. and ideally after your extension is approved,

Yes if she is having difficulties trying to meet the attributes on new rules, then you might as well do itIf 3 years down the line, I apply for ILR, can we both get ILR together? Yes, you both would get ILR together. For ILR, your dependent and you should have been in the UK together for at least two years. And this does not have to be continous stay.

Oh! does that mean she will have to go back to the home country and I will have to apply for her from here in the UK?

She has a valid Tier 1 visa and has been working in the UK. Will that have any bearing on her Dependent visa application?

No.

To change to / be a dependant is a personal choice .. with no reason / justification needed.
