Tier 1 - Dependent - Maintenance Funds Query

Hi,

I have lived in the UK, on and off for 5 years, came back to UK recently (3 months ago) and just started working since 3 weeks. My family was also here in 2010 but they are back in India since months. Now, I am trying to invite them to live with me.

1) Do I need to show the funds as per the rule that says the migrant living in the UK for <12 months? (Evidence of more than £1600 of available funds)?

2) Evidence of more than £533 of available funds if lived in UK for >12 months.

Now, technically I should only show £533 per dependent, but because I came back recently, does that mean I have lived for <12 months and show more maint. funds?

Also, do I need to wait 3 months (for my payslips and bankstatements) before making the visa application for dependents in India? Can I not show them a letter from the current employer and give the previous dependent visa proofs?

Following Details are from the above guidance notes:


43. If the Tier 1 Migrant is outside the United Kingdom or has been present in the United Kingdom for less than 12 months, each family member of the Tier 1 Migrant must show that he/she, the Tier 1 Migrant, or (for children) his/her other parent who is also legally present in the United Kingdom has at least £1600 to support him/her; this is in addition to any funds the Tier 1 Migrant needs to prove he/she has enough money to support himself/herself. Please note dependants of Tier 1 Investors do not need to satisfy the maintenance requirement.

44. If the Tier 1 Migrant has been in the United Kingdom for 12 months or more, each family member of the Tier 1 Migrant must have £533 to support himself/herself.

45. For example, the Tier 1 Migrant has been in the UK for 6 months and is making an application at the same time as his/her spouse and two children. He/she must show that he/she has £1600 for his spouse and a further £1600 for each child, in addition to £800 required for his/her own support. In total the family will require evidence that they hold £5600 in available funds (£1600 x 3 = £4800 + £800).

I did read the guidance, thanks, hence the questions above...

- I have lived here for >5years, was away for 8 months until March 2012, only working since 3 weeks, Technically I fall under "lived here for > 12 months" category, but I just wanted a 2nd opinion from one of the senior members. Does anyone agree that I only need to show £533 for each dependent pls?
