Tier-2 ICT to Tier-2 General and notice period

Hello,

I came here on a Tier-2 ICT Visa to the UK in Dec 2010 and the visa was extended with the same company in Dec-2011 and is currently valid till Dec 2012.

My questions are :-

1. Can I switch in-country from Tier-2 ICT to Tier-2 General?
2. Given that I am on a Tier-2 ICT what is my locus standi vis-a-vis my current employer, as they are asking me to go back to my home country and serve a 2 month notice period there? Can I refuse to do so- what are the implications/choices I have, as I assume the moment I go back to India and resign my current ICT becomes invalid and the 12 month cooling period kicks in?

2. Choice, if any, is dependent on your terms of employment with the current employer / sponsor - something that only you are aware of.

Thanks for the quick response, so for 1 I take it that I am eligible for in country transfer?

As for 2, as said the current employer does have a clause which suggests I have to go back and serve the notice- my doubt is can I refuse to do so and give them a notice in the UK itself?
