Child born in india to ILR holders

Post by mexico » Fri May 18, 2012 12:49 am

Me and my wife will be getting our ILR and ILR dependent in Sept 2012. As my wife is pregnant we are planning to have our child in India Jan 2013 and she wishes to come back to UK with the kid May 2013. What Passport (UK or Indian) will the child need ? If Indian what visa is required to enter UK ?

If child is born in India, then child is not British.

Thanks, so we need Indian passport for the child. Can you tell if the child can apply for settlement as dependent from India ?

Please be aware that settlement visa from India typically takes around 12 week for a decision. Please add this time into your plan.

My wife wants to travel back to UK in April so we have to get the visa sorted before she can actually fly. Can anyone please advice on the following:
::: What visa category should the child visa be applied for (Settlement or Dependent on ILR ?
:: How to apply from India ? VFS VISA4UK portal seems really generic and not visa type specific ...
:: What documents do I need to provide ?
:: Is there any addidtional sponsorship document required ?

Applying from India

Post by mexico » Wed Feb 13, 2013 9:44 pm

http://www.ukba.homeoffice.gov.uk/visas ... /children/

"This page explains how your child or children can join you in the UK if you are a British citizen, or if you have been given permission to settle here permanently (also known as 'indefinite leave to remain').

You cannot apply in the child category if you are the child of a person who is settled in the UK or has British citizenship if their most recent permission to stay was under tiers 1, 2, or 5 of the points-based system and:

your other parent does not yet qualify for settlement; and
your most recent permission to stay as a dependant under the points-based system (known as a PBS dependant) was granted on or after 9 July 2012."

We are applying for Child Visa from India, as per the section on top, should I apply for Settlement of Child or Dependent of the ILR parents or Points based Tier 1 (my visa before settlement) dependent ?

Applying online with url "https://www.visa4uk.fco.gov.uk/AppProce ... check=true", gives an option to select Settlement and then sub-category Settlement there is no option for Dependent of Settled person. ? Should I apply under work category ?
