Firstly, I must say I am an active reader of this forum and I tend to recommend it to my friends who are feeling confuse about all the pit-fall that is part of uk immigration rules.

Secondly, i need to apologize to the moderators if through this login you were able to retrieved threads that I have posted 2 years ago. I was not able to log in my account and therefore created a new one.

I have read through all the thread on this topic and it is very interesting indeed!!
This caused me to think and make preparation for my student dependant husband ILR application.

All the thread so far has dealt with the main application applying for or has received ILR and is concerned about the next step for their spouse or children dependants visa.

In my case, my husband (who is the student dependant for over 9 year)is eligible for ILR under the 10 years rule in Sept. 2012 and is planning to make ILR application 28 days before.
Has a PBS student who is still waiting for the renewal of our visa that was submitted last week, am I correct in understanding that I (and dependent child, not Uk born) need to apply for FLR(M) as the spouse of a person settled here after my husband ILR is granted?. Also, I and one child can apply under the 10years rule 28 days before Dec 2012

The point regarding applying for citizenship for uk-born children has been make quite clear and one which I also intend to pursue.

Thanks to all moderators who have volunteer their time to help us with these issues.

Hi,
As I previouslyr wrote, what about when the dependant apply for ILR first, does the same rule apply? Does the main applicant need to spend 2 years as a dependant( remembering that the main applicant wasn't a dependant at all) before they can apply for ILR?
Would be grateful for an input on this.

If she applies for leave to remain as the spouse of a settled person after being a PBS migrant her own right then yes she will have to wait two years before applying for ilr in that category.
