British dependant

Dear members,

My husband is currently holding a British passport in UK.Iam on Tier1 and my daughter is my dependant.Can me and my child apply from UK as my husband dependant or should we need to go to our home country to apply? Please advice

She was born in India and she is now 2 yrs 6 months old but at the moment she is my dependant (Tier 1 - dependant)

Thanks for your help on directing me on how can I apply from within country .Can you please advice that if I apply as my husband's dependant will I be given a British citizenship or ILR visa? Kindly advice

1. Include child in FLR(M) as a dependant.
2. Neither. You will be given limited leave to remain for 2 years.

One final question. I myself eligible for ILR next august 2013 for continuous 5 yrs stay in UK but I was off for continuos of 4 and half months in India during my maternity period in 2009.Will I still be eligible to apply for ILR as the rule says that I cannot stay away from the country for a long period

Settlement visa as spouse / child of a settled person or British citizen.
27 months (282(a) and 302).
