Naturalisation - Final Year Absence

Post by patel_ilford » Fri May 25, 2012 7:57 am

Dear Members,
Need advices from esteemed Gurus....

I got my ILR on 03-Jan-12 and will be eligible for naturalisation application on 04-Jan-13. I have been absent from UK only for 80-90 days in whole of last 5 years so far.

Though now, due to my job circumstances, I will have to travel outside UK and will be out of UK for around 140 days from now to 04-Jan-13. This means, If I apply for naturalisation on 04-Jan-13, I will be out of UK for around 140 days in final year and 190 days in last 5 years.

It will leave it for case worker discretion to grant me BC but really want to know if that discretion is used frequently or it is just a rule that is not being used. I asked one of the solicitor and he advised that I can not apply on 04-Jan-12.

Please guide.

Regards,

Jambo
