Hi,

I have got initial Tier 1 (General) from Work Permit on 28-July-2010 (while I was in UK). The points claimed for attributes [age, qualification, earnings and UK experience ] was 85 and the points awarded was 75 [10+35+25+5].

I would be eligible for settlement by 10th July 2012. Can I still apply with the same points [75] awarded and my ILR would be approved? Becuase I am still in the same points for the points based attributes.

I have confusions when reading rules On or After 19th July 2010, the points should be 80 for the attribues.

If anyone have the similar experience, please assist.

The points one must score depend on the date of initial application and the rules in place on the date of such application (245CD(d) and 245CD(g)).

The date on which the leave was granted is irrelevant.

Thanks for your reply. I have applied my Tier 1 (General) visa using the same day premium service on 28th July 2010. Please let me know which date did UKBA consider to process.

We have received the BRP cards today. I was outside UK for 219 days and all the days were for business trips.
