Hello people,
I must say thank you for the good work here by all specially the mods....
this is the first post ever in my life of online computing

ok my question is
Does the clock to PR starts with family permit or eea2 residence card
if it starts with eea family permit then you have to count it from the date issued of family permit or the date you enter the uk on it ?
also how can you prove your 5 years residence in uk like what documents proves my 5 years residence in uk ? because sometime they stamp sometime they did not stamp my passport on in and out at the uk airports.

For the EU national, it starts the day they start exercising treaty rights.

For the non-EU family member it starts the day they started living in the member state as the family member of an EU national exercising treaty rights.

If you have a RC, then they should not stamp your passport (also no landing card and you can use the EU line).

There are other ways to prove residence in the UK. Utility bills for example is one of them.

Sorry for being pedantic. With RC they MUST NOT stamp your passport.

can i ask you guys another question pls...

My case is something like this eu family permit applied 2007 dec.
entered uk on 20 jan stayed on eu family permit without applying for eea2
for 1 year, left uk on 21 jan 2009
for spain for 4 continues months and then applied for another eu family permit came back to uk on may 10 2009 applied for a eea 2 received on oct 2009 which is valid until 2014 oct.

now my obvious question is do i qualify in dec 2012 due to first EU FP Issued in 2007 dec.
or 2014 oct as per the eea2 residece card.

please shed some light on the matter.

In general you would break your residency if absent for more than six months in any given year (there are some exceptions).

ok thats good because i wasnt out of uk for more then 6 months but just 4

so can i apply at the end of 2012 on the basis of first family permit at 2007 dec?
or shall continue on eea2 card issued in 2009 and eventually gain pr in 2014?

Yes you can. Your PR will depend on the activities of the EEA national. You as a non EEA national, will need to prove residence during that period.

The EEA national will need to exercise treaty rights and reside in the UK for a continuous 5 years. See more Residence documents for European nationals
