help on ILR application

Post by kkmix » Wed May 30, 2012 12:36 am

hello all needed your help on my application and if you can guide me whether the list of documents is adequate?.

I have been working for a big 4 accountancy firm organisation since Sept 2006 till august 2009, between, I have never stayed outside the country for more than 30 days in any of the 3 years. I was on their work permit during my tenure.

Before leaving the firm, I applied for HSMP then and got my tier 1 for 3 years. I then joined a FTSE 100 organisation in sept 2009. However, after 15 days of my appointment, they had sent me overseas on a significant project for which i was responsible for delivery. This project lasted from Oct 2009 to May 2012.

during my tenure overseas, they paid me from their overseas office. However, I have the following documents from my organisation:

1) Employment contract dated 2009 showing that I was hired for a job in the UK
2) A transfer letter from the overseas office and listing out the project I would be working on including my salary and all
3) A letter from employer stating that when I had been interviewed, what job role I had been offered, what were my responsibilities, why was I sent off overseas to work, what was the project I was working on, what was my role on that project
4) a transfer letter again showing that I had completed the project and resuming work again in the London office
5) bank statements from the overseas country as well from the time when I was in UK (i.e. 2006 to 2009)

Note: I do not have p60? Would I need to pay tax for the time I have spent outside in order to get my application for ILR approved and am I still eligible for ILR given that the time I had been outside the country for employment reasons?

Any replies would be appreciated. My application is on 8th June 2012

If you were absent from UK between Oct. 2009 and May 2012 continuously (approx. 914-943 days) and with no economic ties to the UK (not paid salary in UK, and hence no taxes either), I cannot think how you qualify for settlement.

But if you are indeed successful, it would be amongst a rare case ... and will depend on the justification your organisation provides to support your unduly lengthy absence from UK (in particular why you were the most suitable for the overseas job).

Applying in person would be a waste of money.

IMHO.
