Valid for Tier 4 Dependant Visa?

Hello to all of you!

May I seek your expert advise. Please help us.

My wife is in London now and enrolled in Ealing, Hammersmith & West London Colleges (http://www.wlc.ac.uk/)
with a course of
Level 3 Diploma in Advanced Professional Cookery (Spam & Larder)
This course has a duration of 1 year. A Tier IV Student Visa has been granted to her and indicated an 18-month stay.

My question please, Can I and our 4-year old daughter apply for a Tier IV dependant Visa so we could join my wife and at the same time I work in the UK?

Unless you are already in the UK as her tier 4 dependents or your wife is sponsored by her government, the answer is no.

Dear Geenie,

I really appreciate your speedy response.

I would like to seek enlightenment on the argument at hand.

As per latest UKBA rule:
From 4 July 2011, you cannot bring your dependants to the UK unless you are:

1. sponsored by a higher education institution on a course at NQF level 7 or above which lasts 12 months or more; or

2. a new government-sponsored student following a course which lasts longer than 6 months.

Going back to our scenario, as per CAS, the course indicates a NQF 6 rating as opposed to the required NQF 7 stated in the condtion 1. Although, the course is indeed 12 months long. Will this be considered?

Is Ealing, Hammersmith & West London Colleges HEI?

In your first post you said the course was NQF 3, now you are saying is it NQF 6. Nevertheless it does not make a difference, the course must be NQF7 or above if she is not government sponsored. (The course is Level 3 according to the college's website)

Ealing, Hammersmith and West London College is not an HEI
