Hello all,

We received our EEA2 documentation back today. A letter enclosed states that our application cannot be considered because we need to provide additional evidence that the EEA national is exercising treaty rights. It states that if your EEA sponsor is employed: "an original, recent signed and dated employer's letter plus a supporting pay slip dated within six weeks of the submission date" is needed.

With our original application, we enclosed:
(1) original contract when my husband started working in London dated from Aug 2010
(2) original P60 from tax year up to April 5 2012
(3) 3 original payslips, dated from May 15, 2012, April 14, 2012, and March 15, 2012

I am so confused. Is this not sufficient to show that he is exercising treaty rights in the UK? Or is providing an original signed and dated employer's letter mandatory? I thought the option was to provide either payslips or a contract, or employer letter?

Please help!!!!

You are right. The HO made a mistake. Reapply.

As you attached a recent (15/05) payslip I presume you have received the application back just 1-2 weeks after posting it.

The HO operates an initial screening process ("validating the application") to make sure the required documents are submitted with the application. It seems you (wrongly) failed this stage.

If I were you, I would send one type of evidence to prove employment and not three. Make the application simple.

Yes, we submitted our application this month, and now am so stressed... my husband needs to travel on June 15th, and we had requested to get his passport back, did not expect to get the whole application returned to us as well.

We just reapplied and sent in a letter from HR verifying his work status anyways... not sure how HO could have overseen what we originally included, as I did reference each of the items in my cover letter as well. Hoping we can get his passport in time now :( :( :(

I doubt he will get the passport back in time for his travel. It takes the HO a few days to return the passport and with the long weekend, I would be surprised if someone would even read your request before the travel date.
