Child British Citizenship

Hi,

I am on Tier 1 General Visa from Jan 2008 and next year in January 2013 I am eligible to apply for ILR. I am currently three months pregnant and my baby is due at end of November 2012. My questions are –

1) Can I exclude child from dependant ILR visa in January 2013 (I do not have urgent travel plan)?

2) As soon as I get the ILR on my passport in January 2013, can I get the child to register as British Citizen - this way I think I not only save the money but also be saved from applying for child's Indian passport.


Please can you confirm if I am thinking correctly here.

rachsach, for the record, given I am not going to assume, do you intend the child to be born in the UK, or outside the UK?

Thank you Jambo for answering my query. I have another question and I know I am thinking too much but I do not want to leave anything unturned so please can you confirm is there any requirement for me to register/get child passport from Indian High Commission before applying for child British Citizenship?

I can confirm I do not have any plan to travel outside UK

There is no such Indian requirement.

Given the baby is going to be born in the UK, as soon as you have your ILR, a section 1(3) application can be made, using form MN1, to register the baby as British.

A section 1(3) application is an entitlement application ..... no UKBA discretion involved.

Thanks John that cleared the doubt but as you have stated MN1 form for registering baby as British Citizen - once registeration is done and if I have to travel abroad with my baby, do I need apply for my baby British passport before travelling OR baby registeration using MN1 would send his/her British passport anyway?

No you need to apply for the passport after the child is registered as British.

Your baby will need a British passport and Indian entry visa in order to travel to India. If however, you decide not to register your child as a British citizen, you will need to apply for an Indian passport (if eligible) and then a UK Visa.

As stated above, after you have registered your child as british, you will need to apply for a British passport for the baby.

Whether or not your baby will then require a visa to travel to India using that passport will depend on the visa requirements India have for British passport holders.

I'm personally not familiar with the visa requirements for British passport holders to travel to India. But if a visa is required, then your baby will need one to travel to India after he/she is granted a British passport.

Thanks Guys, I had a blonde moment - didn't read Greenie reply correctly.


I have no urgent (at least for few years) plans to apply for British Citizenship after the ILR and if I get my baby registered as British Citizen then I will have to apply for his/her visa every time I will go to India.

Pls can you advise if it is better for baby to get ILR on Indian passport endorsed at the same time with us rather than registering him/her for British Citizen.

Well, this depends whether you want your child to be Indian (with all it's advantages/disadvantages) or British (with all advantages/disadvantages).

No one can advice you which one is better. It all depends on your personal preference /circumstances.

Application for registration as BC can be made later in the child life (until his is 18). You don't need to do it immediately after ILR.
